This English privacy policy is a translation of the German version. In the event of discrepancies, the German version shall be used for interpretation.

We process personal data only where necessary to operate this website, respond to enquiries, take steps prior to entering into a contract, process applications or comply with legal obligations.

3. Accessing the website and server log files

When this website is accessed, the web server processes connection data that is technically required to deliver the website. This may include:

  • HTTP status code
  • previously visited page, where transmitted by the browser
  • browser type and version

The legal basis is Article 6(1)(f) GDPR. Our legitimate interest is the secure and reliable operation of this website.

The data is deleted once it is no longer required for these purposes. It may be stored for a longer period where this is necessary to investigate a specific security incident or comply with a legal obligation.

4. Hosting

We use an external hosting service provider to operate and provide this website. The hosting provider processes data generated when the website is accessed on our behalf, where this is necessary to provide and secure the technical infrastructure.

Where legally required, a data processing agreement pursuant to Article 28 GDPR has been concluded with the hosting provider.

The legal basis is Article 6(1)(f) GDPR. Our legitimate interest is the reliable, secure and economically reasonable provision of this website.

This website uses the technically necessary cookie bs_locale. The cookie stores the selected language so that the website can be displayed in the preferred language during future visits.

The cookie is not used for analytics, advertising or tracking.

The cookie is stored pursuant to Section 25(2) no. 2 of the German Telecommunications Digital Services Data Protection Act (TDDDG), as it is necessary to provide the language setting expressly requested by the user.

Where the stored information constitutes personal data, further processing is based on Article 6(1)(f) GDPR. Our legitimate interest is providing a user-friendly and consistent language setting.

The cookie remains stored until the configured expiry date is reached or it is manually deleted through the browser. Cookies can be deleted or blocked at any time through the browser settings. Blocking the cookie may prevent the language preference from being stored permanently.

6. Contact form

A contact form is available on the contact page. The following information is processed when the form is used:

  • name
  • email address
  • company, where provided voluntarily
  • subject
  • message
  • time of submission
  • technically required connection data

The information is used to process and respond to the enquiry. Contact form submissions are forwarded to us by email and are not permanently stored in the website's database.

Where an enquiry relates to a contract or steps prior to entering into a contract, processing is based on Article 6(1)(b) GDPR.

Other enquiries are processed on the basis of Article 6(1)(f) GDPR. Our legitimate interest is processing and responding to business, editorial and general enquiries.

Where express consent is requested through the form, Article 6(1)(a) GDPR also applies. Consent may be withdrawn at any time with effect for the future. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal.

The data is deleted once the enquiry has been fully resolved and no statutory retention obligation or other legitimate reason for continued storage applies.

7. Contact by email or telephone

When you contact us by email or telephone, we process the information provided, including your name, contact details, the content of the enquiry and any other information submitted voluntarily.

The information is processed to handle and respond to the enquiry.

The legal basis is Article 6(1)(b) GDPR where the enquiry relates to entering into or performing a contract. In all other cases, the legal basis is Article 6(1)(f) GDPR. Our legitimate interest is processing communications addressed to us.

The data is deleted once the purpose of the communication has been fulfilled and no statutory retention obligation or other legitimate reason for continued storage applies.

8. Applications

Applications and unsolicited applications may be submitted, in particular, by email to jobs@brunsward-studios.de.

During the application process, we process the information required to assess and manage the application. This may include:

  • name and contact details
  • curriculum vitae
  • qualifications and employment history
  • work samples and portfolio
  • certificates and other application documents
  • communications relating to the application process

The legal basis is Section 26(1) of the German Federal Data Protection Act in conjunction with Article 6(1)(b) GDPR.

Where application documents voluntarily contain special categories of personal data within the meaning of Article 9 GDPR, such data is processed only where permitted by law or required for the exercise of rights and obligations under employment law.

Where no employment relationship is established, application data is generally deleted no later than six months after the application process has ended. Data may be stored for a longer period where consent has been given for inclusion in an applicant pool, a legal obligation applies or the data is required for the establishment, exercise or defence of legal claims.

Consent to longer storage may be withdrawn at any time with effect for the future.

9. Email service providers

Technical email infrastructure is used to receive and send emails. This may involve the processing of sender and recipient addresses, transmission times, subject lines, message content, technical transmission data and attachments.

Where an external service provider is used, processing is carried out on our behalf or under the independent responsibility of the respective service provider.

The applicable legal basis depends on the content of the communication and may be Article 6(1)(b), Article 6(1)(c) or Article 6(1)(f) GDPR.

10. RSS feed

This website provides an RSS feed. When the RSS feed is accessed, the same technically required connection data is processed as when a normal website page is accessed.

No additional analysis or creation of user profiles takes place.

The legal basis is Article 6(1)(f) GDPR. Our legitimate interest is the technical provision of the RSS feed.

11. No analytics, advertising or tracking services

This website currently does not use web analytics, advertising or tracking services.

No personal usage profiles are created. Personal data is not processed for personalised advertising and is not shared with advertising networks.

A cookie consent banner is therefore not currently used. Should the website use cookies or similar technologies requiring consent in the future, consent will be obtained before they are used and this privacy policy will be updated accordingly.

This website may contain links to external websites. Merely accessing our website does not cause data to be transmitted to the operator of a linked website.

A connection to the external website is established only after the external link is selected. The operator of the external website is generally responsible for any processing that takes place there.

13. Recipients of personal data

Where required for the relevant purpose, personal data may be disclosed to the following categories of recipients:

  • hosting and infrastructure service providers
  • email and communication service providers
  • technical IT service providers
  • legal, tax or other professional advisers
  • public authorities where disclosure is required by law

Personal data is not sold or disclosed for advertising purposes.

14. Transfers to third countries

Personal data is transferred to recipients outside the European Union or the European Economic Area only where the requirements of Articles 44 et seq. GDPR are met.

Where such a transfer takes place, it is based in particular on an adequacy decision by the European Commission, appropriate safeguards such as standard contractual clauses or a statutory exception.

15. Retention periods

Personal data is stored only for as long as necessary for the relevant processing purpose.

Data may be stored for a longer period where statutory retention obligations apply or storage is required for the establishment, exercise or defence of legal claims.

Once the relevant purpose no longer applies and any retention periods have expired, the data is deleted or anonymised.

Depending on the type of processing, the following legal bases may apply:

  • Article 6(1)(a) GDPR where consent has been given
  • Article 6(1)(b) GDPR for contracts and pre-contractual measures
  • Article 6(1)(c) GDPR for compliance with legal obligations
  • Article 6(1)(f) GDPR for legitimate interests
  • Section 26 of the German Federal Data Protection Act for application and employment data

Subject to the applicable legal requirements, data subjects have the following rights:

  • right of access pursuant to Article 15 GDPR
  • right to rectification pursuant to Article 16 GDPR
  • right to erasure pursuant to Article 17 GDPR
  • right to restriction of processing pursuant to Article 18 GDPR

18. Right to object

Where personal data is processed on the basis of Article 6(1)(f) GDPR, data subjects have the right to object to the processing at any time on grounds relating to their particular situation.

Following an objection, the relevant data will no longer be processed unless compelling legitimate grounds for the processing exist or the processing is required for the establishment, exercise or defence of legal claims.

19. Right to lodge a complaint

Under Article 77 GDPR, data subjects have the right to lodge a complaint with a data protection supervisory authority.

A complaint may be submitted, in particular, to the supervisory authority responsible for the data subject's habitual residence, place of work or the place of the alleged infringement.

20. Requirement to provide data

There is no statutory or contractual requirement to actively provide personal data when merely visiting this website.

Certain technical data is nevertheless required to deliver the website.

When using the contact form, the information marked as mandatory is required to process and respond to the enquiry. Without this information, the enquiry may not be submitted through the form.

21. Automated decision-making and profiling

No decision based solely on automated processing within the meaning of Article 22 GDPR takes place.

This website is provided through an encrypted HTTPS connection. This protects data transmitted between the user's device and the website against unauthorised access during transmission.
